For 15 months after his death his family had only been told he had died in police custody. In June this year they found the details of the events that led to his death, including that his death was filmed by a TV crew (who had since deleted the footage) and that the arrest was so aggressive an officer could be heard saying “ah, pretty sure I just broke his finger.” And this was a man who was unarmed, not resisting, had surrendered, and was repeatedly pleading that he suffered from congestive heart failure.
What was his crime?
This capital crime was for not stopping after not dimming his headlights.
His family and friends suspect that if the police officers had not been with a TV crew from the Live PD show at the time this would never have escalated and Javier might still be alive.
All officers involved were cleared after an Internal Affairs investigation, but after the body cam footage was released this week the DA has said the case could go to a grand jury. So, it is possible, but unlikely that justice may be served.
